Guidelines for Automatic Import License of Mechanical and Electronic Products

I. Legal Basis

(I) Article 5 of the Administrative Measures for Import of Mechanical and Electronic Products (Order of the Ministry of Commerce, the General Administration of Customs and the General Administration of Quality Supervision, Inspection and Quarantine [2008] No.7) specifies: "The Ministry of Commerce shall be responsible for the management of imports of mechanical and electronic products of the State. The offices of import and export of mechanical and electronic products of all provinces, autonomous regions, municipalities directly under the Central Government and cities specifically designated in the State plan, costal open cities, the Special Economic Zones and the relevant department of the State Council (hereinafter referred to as the local or departmental electromechanical offices) shall be responsible for the import management of mechanical and electronic products of their respective regions and departments with the authorization of the Ministry of Commerce"; Article 18 specifies: "To import the mechanical and electronic products with automatic import license, the import entities shall apply for and obtain the Automatic Import License of the People's Republic of China (hereinafter referred to as the Automatic Import License) from the Ministry of Commerce, the local or departmental offices of import and export of mechanical and electronic products prior to the Customs clearance procedures. They shall conduct the Customs clearance procedures by virtue of the Automatic Import License and in accordance with the provisions of the Customs. ".

(II) Article 4 of the Implementing Measures for the Automatic Licensing of the Import of Mechanical and Electronic Products (Order of the Ministry of Commerce and the General Administration of Customs [2008] No.6) specifies: "The mechanical and electronic products to be imported by means of the general trade (including parts and materials to be imported by foreign investment enterprises for domestic sale), barter trade, lease, aid, presents and donations as well as the products on the Import List of Mechanical and Electronic Products under Automatic License that China's overseas institutions or enterprises purchased abroad but needing to take back for their own use shall be subject to an application for the Import Automatic License"; Article 5 specifies: "To import mechanical and electronic products under the import automatic license, the import entity shall apply to the MOC or its authorized institution for the Import Automatic License before it goes through the customs formalities. To apply for the import of mechanical and electronic products for which a bid shall be organized in accordance with laws and administrative regulations, the import entity shall organize the bid before signing the contract."

II. Application Requirements

The import of mechanical and electronic products applied for conforms to the business scope of the import entity concerned.

III. Application Materials

Electronic versions of the following materials are required to be submitted:

(I) the Application for Import of Mechanical and Electronic Products and the Schedule (they may be downloaded from the public website of the Sichuan Provincial Department of Commerce: swt.sc.gov.cn. In filling in the Application for Import of Mechanical and Electronic Products and the Schedule, please affix the corporate seal of importer, and mark the expected arrival time at the column of "Remarks");

Remarks: 1. For the import of any mechanical and electronic products to be approved by the Ministry of Commerce, the Application for Import of Mechanical and Electronic Products in two counterparts shall be provided.

2. For the import of any mechanical and electronic products to be approved by the Sichuan Provincial Department of Commerce, the Application for Import of Mechanical and Electronic Products in one counterpart shall be provided; if there is the Schedule, the Schedule in three counterparts shall be provided.

(II) the copy of duplicate of the business license of the importer;

(III) the import and order contract concerned (during the submission of electronic data online, mark the contract No. and the expected time of arrival at port at the column of "Descriptions of enterprise import");

(IV) the report on application for import (the report shall specify the profile of the enterprise and the reason for import. During the submission of electronic data online, briefly mark the aforesaid contents at the column of "Descriptions of enterprise import");

(V) the power of attorney, if the enterprise entrusts others to make an application for import; and

(VI) In any of the following circumstances, materials below shall be provided accordingly:

1. to import mechanical and electronic products that are subject to national compulsory certification, the China National Compulsory Product Certification or the Certificate for Exemption from Compulsory Product Certification shall be provided;

2. to import mechanical and electronic products under an investment project, the project approval or filing document (copy) issued by the competent authority of the project investment shall be provided;

3. to import mechanical and electronic products with the application of authorized operation, the certification materials of authorized operation shall be provided;

4. to import relevant spare parts or components of mechanical and electronic products under administration of licensed production for production use, the certification materials of licensed production (copies) shall be provided;

5. to import used mechanical and electronic products, the import product pre-inspection report issued by the inspection and quarantine agency delegated or licensed by the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China shall be provided;

6. to import used mechanical and electronic products for retreading (including remanufacturing), relevant proof materials for engaging in the retreading business shall be provided;

7. To import mechanical and electronic products purchased through international bidding, the Notice of International Bid Evaluation Result signed and issued by the competent authority of international bidding shall be provided; and

(VII) other necessary materials as prescribed by the Ministry of Commerce.

Import entities shall be responsible for the authenticity of materials submitted, and their business activities shall conform to the state laws and administrative regulations.

IV. Handling Procedures

(I) The applicant shall submit the aforesaid application materials to the "Window for Provincial Department of Commerce" of the Sichuan Provincial Government Affairs Service and Public Resources Exchange Service Center;

(II) After verification, the Sichuan Provincial Department of Commerce shall issue the Automatic Import License; if the Automatic Import License should be issued by the Ministry of Commerce, the Sichuan Provincial Department of Commerce shall, after verification, forward the application materials to the Ministry of Commerce for examination and approval.

(III) The applicant shall get handling result by virtue of the ID card thereof and relevant notice of acceptance.
