Instructions for Filling in the Application for Import of Mechanical and Electronic Products

In order to enhance work efficiency and guide import entities to accurately fill in the Application for Import of Mechanical and Electronic Products, relevant filling issues are hereby described as below:

I. Methods of Trade

Methods of trade refer to the methods of import of goods, which mainly reflect the compositions of mechanical and electronic products imported by different methods of import.

1. General trade

It refers to the imported goods traded by normal means, the goods picked up from bonded warehouses and sold within the territory of China, the goods temporarily imported originally and not re-exported but sold within the territory of China (such as exhibits), imported goods from loan aid as well as materials and parts imported by foreign-invested enterprises for processing of products for domestic sales.

2. Materials freely provided and presented by other countries and international organizations

They refer to the materials freely provided, donated or presented by international organizations and foreign governments and organizations for Chinese governments and organizations. The aforesaid materials are generally accepted via Chinese governments, organizations (including local governments and organizations), red cross societies and other institutions.

3. Materials donated by overseas Chinese, compatriots in Hong Kong, Macao and Taiwan or foreign Chinese

They refer to the materials and equipment willingly donated by overseas Chinese, compatriots in Hong Kong, Macao and Taiwan or foreign Chinese, as well as gifts given by foreigners during non-economic and non-trade exchanges.

4. Consignment trade

It refers to the trade form that a consignor transports goods to a consignee, and the consignee sells the goods on the local market as per conditions specified in relevant consignment agreement, and pays the consignor the balance of sales monies of the goods net of the commissions and other expenses thereof in the form stipulated in the agreement. There is an entrustment relationship between the consignor and the consignee, and the consignee does not have the ownership of the goods.

5. Leasing trade

It refers to the goods imported by means of leasing under an international lease trade contract concluded by and between an enterprise doing the leasing business and a foreign merchant.

6. Tax-free foreign exchange commodities

They refer to the tax-free foreign exchange commodities imported by approved business entities and specially sold for Chinese people going abroad, overseas Chinese, foreign Chinese, compatriots in Hong Kong, Macao and Taiwan and other relative visiting persons in China, Chinese citizens about to visit relatives abroad and diplomatic personnel in China.

II. Sources of Foreign Exchanges

This indicator primarily reflects the composition of foreign exchanges used for the import of mechanical and electrical products.

1. "Foreign exchanges purchased from bank" refer to foreign exchanges purchased from a designated foreign exchange bank by virtue of corresponding foreign exchange purchase voucher.

2. "No payment of foreign exchanges" involves the goods imported by means of free aid, donation, compensation trade, barter trade, consignment trade, etc. as well as the goods imported free of charge.

3. "Domestic loan foreign exchanges" refer to loan foreign exchanges by a domestic financial institution. They do not include foreign loans transferred by a domestic financial institution.

4. "Foreign loan foreign exchanges" refer to loan foreign exchanges by a foreign government or financial institution. They include foreign loans transferred by a domestic financial institution. They are classified into "loans of the World Bank", "loans of the Asian Development Bank", "loans of the Japan Bank for International Cooperation" (including loans of the former Japan Overseas Cooperation Fund and loans of the former Export-Import Bank of Japan) and "other foreign loans".

5. Other foreign exchanges refer to foreign exchanges other than those of the aforesaid sources. They specifically include "cash", "labor services", "free assistance", "foreign capital", "presents", "claims" and "foreign repatriation".

III. Uses of Commodities

Uses of commodities refer to the actual uses of imported mechanical and electronic products:

1. self-use (i.e. the self-use for production and management);

2. production supporting (i.e. the commodities are processed and assembled to form final products for sales);

3. sample imitation or cooperative manufacturing;

4. direct sales;

5. spare parts for repair; and

6. others.

IV. Unit Price, Total Value and Conversion of Total Value into USD

The unit price refers to the unit foreign currency price of imported mechanical and electronic products. Total value refers to the foreign exchange price of imported mechanical and electronic products. The conversion of total value into USD is the USD value of other foreign currency converted as per relevant foreign exchange rate of the State.

For imported mechanical and electronic products freely aided and presented by foreign governments and international organizations, donated by overseas Chinese and compatriots in Hong Kong, Macao and Taiwan and presented by foreign merchants, and those with no foreign exchanges paid, their value is taken as the total value thereof.

V. Country (Region) of Trade

It is determined by the country concluding a contract (agreement) with a Chinese enterprise or the country (region) where the manufacturer of trade is located. For the trade with a Chinese institution in Hong Kong or Macao, Hong Kong or Macao may be filled in. The 1-2 countries (regions) of trade may be filled in for this column.

VI. Country (Region) of Origin

It refers to the country (region) producing or processing and manufacturing the imported goods. For the imported goods processed and manufactured by several countries, the last country (region) which economically and substantially processes the goods is taken as the country of origin of the goods. The 1-4 countries (regions) of origin may be filled in for this column.

VII. Port of Entry

It refers to the name of the customs port at which an importer declares imported mechanical and electronic products. An importer may fill in the name of any directly competent customs or customs regions, and declare at any customs under the jurisdiction of the aforesaid directly competent customs or customs regions. In terms of products for which a port is designated for customs declaration, relevant state provisions shall prevail. The 1-2 port customs may be filled in for this column.

VIII. Commodity Codes

Customs commodity codes are adopted as the commodity codes in the Catalog of Mechanical and Electronic Products under Automatic Import Licensing Administration in 2009.

Only one commodity code shall be filled in at the commodity code column. As for specially regulated goods such as whole vehicles, the 1-4 specifications and models of one brand only can be filled in under a commodity code.

IX. Specifications and Models

They refer to standards and types of imported mechanical and electronic products. At most four specifications and models can be filled in for this column.

X. Import Type

It refers to the import of mechanical and electronic products in the form of single machine or a project.

XI. Project Types

The indicator of project type primarily reflects the composition of projects with different investment natures.

1. "Basic construction project" refers to a new construction or expansion engineering project aimed at the expansion of production capacity (or an increase in engineering benefits).

2. "Technical transformation project" refers to the project of technical transformation (including the renewal of fixed assets) of any original facility of an existing enterprise or public institution.

3. "Other project" refers to any other project, except any of the aforesaid projects.

4. It is unnecessary to fill in this column for the import of a single machine.

XII. Remarks Column

Only the date of arrival, "non-one-batch-one-license" or "features of whole vehicles" is/are filled in for this column. No other contents shall be filled in. If customs declaration cannot be conducted once off for any imported mechanical and electronic products, the "non-one-batch-one-license" shall be filled in. If complete sets of parts of vehicles are imported to assemble complete vehicles, the "features of complete vehicles" shall be filled in.

XIII. Equipment Status

It means the mechanical and electronic products are new or old at the time of import.

The application form of import is needed to be filled in only for the application for import of commodities set out in the Catalog of Mechanical and Electronic Products under Automatic Licensing Administration in 2009.
